§ 1 General Provisions
The lukaszkujawaart online store, available at https://lukaszkujawaart.com.pl, is operated by Łukasz Kujawa, who conducts business under the name Łukasz Kujawa, registered in the Central Register and Information on Economic Activity of the Republic of Poland (CEIDG).

These Terms and Conditions are intended for both Consumers and Business Customers using the Store and set forth the rules for using the Online Store, as well as the rules and procedures for entering into distance sales contracts with Customers.
§ 2 Definitions
Consumer – a natural person who enters into a contract with the Seller through the Store, the subject matter of which is not directly related to their business or professional activities.
Seller – a natural person conducting business activity under the name Łukasz Kujawa, registered in the CEIDG, Tax ID (NIP): 9271822150, Statistical ID (REGON): 383032084.
Customer – any entity making purchases through the Store.
Business user – a natural person, legal entity, or organizational unit engaged in business activities that uses the Store.
Store – the online store operated by the Seller at https://lukaszkujawaart.com.pl.
Distance contract – a contract concluded with a customer through an organized system for concluding distance contracts, without the parties being physically present at the same time.
Terms and Conditions – these Terms and Conditions of the Store.
Order – a declaration of intent by the Customer aimed directly at entering into a Sales Agreement.
Account – the customer’s account in the Store, where the data provided by the Customer and information about orders placed are stored.
Order Form – an interactive form that allows you to place an order in the Store.
Shopping Cart – a section of the Store where the Products selected by the Customer are displayed.
Product – a tangible item or service available in the Store that is the subject of the Sales Agreement.
Sales Agreement – a contract for the sale of a Product entered into between the Customer and the Seller.
§ 3 Products and Orders
The paintings available in the store are unique and created as one-of-a-kind pieces.
The posters available in the Store may be printed in limited quantities.
The products available in the Store are shown in the photos, but they may differ slightly from the actual items (e.g., color variations due to monitor settings).
Orders can be placed 24/7, but they are processed on business days.
The customer receives an order confirmation via email.
Order Processing and Data Handling
The online store operates on the WooCommerce platform, which enables the processing of orders, payments, and shipping. As part of order fulfillment, we process users’ personal data, such as:
- First and last name
- Email address
- Shipping address
- Invoice information (if applicable)
- Information about the products you ordered
The processing of this data is necessary to fulfill the order and perform the sales contract.
§ 4 Rules for Placing an Order
A customer may place an order as a registered user or without registering.
To place an order, please:
Select a product and add it to your cart.
Fill out the order form.
Select a payment and shipping method.
Click "Order and Pay."
§ 5 Order Processing Time
Ready-to-sell paintings – shipped within 3–7 business days (Poland), 7–24 business days (Europe and worldwide).
Custom paintings – production time is 14–60 business days, plus shipping time.
1. The turnaround time for custom paintings depends on:
a) The complexity of the contract,
b) The workload of the workshop,
c) Any consultations regarding the project (if applicable).
2. The customer receives an estimated delivery date upon order confirmation, and any delays are communicated as they arise.
3. Custom-made paintings are not eligible for return or exchange, in accordance with Article 38(3) of the Consumer Rights Act.
4. Before commencing work, the Seller may require an advance payment of 30–50% of the order value.
a) If the order is canceled after work has begun, the advance payment is non-refundable.
Posters, Art Prints, Canvas Prints – shipped within 5–10 business days (Poland and Europe).
Delivery times may vary depending on the destination country and shipping method.
§ 6 Shipping and Delivery Costs
Paintings – shipped worldwide.
Posters, Art Prints, Canvas Prints – Shipping available only to Poland and Europe.
Free shipping is available within Poland.
Shipping costs to countries outside Poland are listed on the Store’s website or calculated on a case-by-case basis.
§ 7 Payment Methods
Customers can make payments in PLN and EUR.
Payments in PLN can be made via:
Przelewy24 (Online transfers, BLIK, Google Pay, Apple Pay).
Credit cards (VISA, Mastercard).
An approximate price in EUR is available after using the currency converter plugin.
§ 8 Personal Data
Data Controller – The data controller for Customers’ personal data is the Seller – Łukasz Kujawa, operating under the business name Łukasz Kujawa, registered in the Central Register and Information on Economic Activity (CEIDG).
Purpose of personal data processing – The Customer’s personal data is processed for the following purposes:
Performance of the Sales Agreement – data processing is necessary for the conclusion and performance of the agreement (e.g., shipping of goods, payments, contact with the customer).
Compliance with legal obligations arising from tax and accounting regulations.
Marketing – if the customer gives their consent, the data may be used to send newsletters and information about new products and promotions.
Scope of data processed – The Controller processes the following Customer data:
First and last name,
Shipping address and billing address,
Email address,
Phone number,
Payment details (e.g., bank account number, for refunds).
Recipients of personal data – The Customer’s personal data may be disclosed solely for the purpose of fulfilling the order and processing payments, including:
Courier companies – for the purpose of delivering the order,
Payment service providers – for the purpose of processing electronic payments,
Entities that maintain the Store’s IT systems, if necessary for the operation of the website,
Public authorities—if required by law (e.g., at the request of tax authorities or courts).
Data retention period – Personal data will be retained:
If a contract is concluded—for the period necessary for its performance, and thereafter for the period required by tax and accounting regulations (5 years).
If consent is given for marketing purposes – until the Customer revokes it.
Customer Rights Regarding Personal Data Protection – The customer has the right to:
Access to your personal data,
Correction of data if it is incorrect,
Deletion of data (“right to be forgotten”) in cases provided for by law,
Restrictions on data processing,
Transfer of data to another controller,
Object to the processing of your data,
You may withdraw your consent to the processing of your data for marketing purposes at any time.
Data security – The Seller implements appropriate technical and organizational measures to protect personal data against unauthorized access, loss, or alteration.
Abandoned Cart Tracking:
If you add a product to your cart and enter your email address in the order form but do not complete your purchase, we may send you a message reminding you of your unfinished order.
This message is intended to help you resume your shopping and may include additional information, such as product availability or personalized offers.

§ 8 Personal Data – Cookie Policy
This store uses cookies and other similar technologies to ensure the website functions properly, analyze traffic, and tailor content to user preferences.
Detailed information about the types and functions of cookies used on the Store is provided in the Privacy Policy, available on the Store’s website.
Customers can manage their cookie settings through their web browser settings. Restricting the use of cookies may affect certain features of the Store.
§ 10 Warranty
The seller does not offer a warranty on paintings and posters, as these are artistic products whose characteristics may change over time depending on storage conditions.
The customer is required to store and display the painting under appropriate conditions, i.e., away from moisture, excessive sunlight, and heat sources.
§ 11 Securing Packages and Reporting Transport Damage
Packaging and securing products
All paintings and posters are carefully packaged to protect them from physical damage.
The paintings are shipped in reinforced cardboard boxes, wrapped in bubble wrap or other protective materials.
The posters are shipped in protective tubes to prevent damage.
The obligation to inspect the shipment upon delivery
The customer is required to inspect the condition of the package upon delivery in the presence of the courier.
If the packaging is damaged, the customer should:
Refuse to accept the package and file a complaint with the courier.
If you receive a package, fill out a damage report with the courier.
Procedure for Reporting Transport Damage
If transport damage is found, the Customer should:
Fill out the damage report—a form available from the courier (to be completed upon delivery).
Take photos of the damage to the packaging and the product.
Please report any complaints to the Seller immediately (no later than 24 hours after receiving the package) by sending an email to lukaszkujawaart@gmail.com with the following information:
Order number,
Description of the damage,
Photos of the package and the damaged product,
A copy of the damage report prepared with the courier.
Claims submitted without a damage report may be rejected if the damage could have occurred after the package was received.
Liability for damage caused during transport
The seller is responsible for delivering the goods to the carrier in undamaged condition.
The courier company is liable for any damage that occurs during transport.
If the customer reports the damage in accordance with the procedure, the seller will take steps to obtain compensation from the carrier and will either provide a replacement product or issue a refund.
§ 12 Return and Complaint Policy
The seller is liable under the warranty for physical and legal defects in the product in accordance with the provisions of the Civil Code.
1. Returns
Unique artworks – the artworks available in the Store are one-of-a-kind pieces, which means that, pursuant to Article 38(3) of the Consumer Rights Act, they are non-returnable.
The customer accepts this condition at the time of placing the order.
Returns are accepted only in the event of product defects resulting from the Seller’s error or damage incurred during shipping (in accordance with the returns policy).
Posters, Sizes, Canvas Prints – Customers who are consumers have the right to return items within 14 days of receiving their order, in accordance with the provisions of the Consumer Rights Act.
To make a return, the Customer must notify the Seller of their decision by email at lukaszkujawaart@gmail.com.
The product must be returned in pristine condition, with no signs of use, and in its original packaging.
The customer is responsible for the cost of returning the product.
The refund will be issued to the Customer’s account within 14 days of the Seller receiving the product.
2. Refunds for Canceled Orders
The customer may cancel an order before it is processed by notifying the Seller via email at lukaszkujawaart@gmail.com.
If the order has already been shipped, it cannot be canceled—in this case, our return and refund policy applies.
Refunds are issued within 14 business days of the cancellation being approved.
Funds refunded to the customer's account.
For card payments, the refund may take up to 7 business days, depending on the customer's bank.
3. Complaints
Grounds for a complaint – A customer may file a complaint if:
He received a product that was damaged during shipping (a damage report must be filed upon delivery).
The product has physical defects or does not match the description.
Submitting a Complaint – You can submit a complaint:

Order number,
Description of the problem,
Photos of damage/defects.
Complaint processing time – Complaints are processed within 14 days of the date of submission.
Handling of complaints – If the complaint is deemed valid, the Seller will:
We will replace the product with a new one (if possible).
It will fix the damage.
They will refund the money if replacement or repair is not possible.
Exceptions to complaints – Complaints will not be accepted if:
The damage was caused by improper use (e.g., exposing the image to moisture or direct sunlight).
Differences in color are due to the customer's monitor settings.
The product shows signs of tampering or has been modified by the customer.
The cost of returning a product under warranty
If a complaint is upheld, the Seller will cover the cost of returning the product.
If a claim is rejected, the customer is responsible for the shipping costs.
§ 13 Seller's Liability
The seller is not liable for:
Damage resulting from the Customer's improper use of the images,
Differences in color resulting from the customer's monitor settings,
Delays in delivery caused by courier companies.
The seller makes every effort to ensure that packaging and shipping are safe and careful, but is not liable for damage to the package if the customer did not report the damage at the time of delivery.
§ 14 Copyright and Restrictions
All images and posters available in the Store are protected by copyright under the Copyright and Related Rights Act.
A customer who purchases a painting or poster acquires the right to own and display the artwork, but does not acquire the copyright to reproduce, copy, or use it for commercial purposes.
The customer may not:
Use the works for marketing or promotional purposes,
Share the image for commercial printing purposes,
Sell digital copies of purchased works.
Any infringement of copyright is subject to legal action.
§ 15 Amendments to the Rules and Regulations
The Seller reserves the right to amend these Terms and Conditions in the event that:
Changes to the law,
The introduction of new services or changes to the Store’s operations.
Customers will be notified of the changes at least 7 days before they take effect.
Orders placed before the Terms and Conditions were amended will be processed in accordance with the rules in effect at the time they were placed.
§ 16 Promotions and Discounts
The seller may run promotions on select products, valid for a limited time or while supplies last.
Discounts cannot be combined—if a customer has multiple promo codes, they can use only one per order.
These promotions apply only to orders placed during the promotional period and cannot be applied retroactively.
The seller may offer discounts to customers who:
They signed up for the newsletter,
They made a purchase exceeding a certain amount,
They are regular customers (loyalty program).
The detailed terms and conditions of the promotion are posted each time on the Store’s homepage and on the Seller’s social media accounts.
§ 17 Certificates of Authenticity
Every painting purchased from the Store is unique and sold as a one-of-a-kind piece.
Each painting comes with a Certificate of Authenticity, which includes:
The title and description of the work,
Part number,
The artist's signature,
Year of establishment.
The certificate attests to the painting's authenticity and artistic value.
The customer may not copy or reproduce the image, formats, or canvas prints for personal use without the Seller’s written consent.
§ 18 Complaints by Business Customers
By making a purchase in the Store, the customer acknowledges that:
He is not entitled to the statutory consumer rights regarding the return of goods within 14 days.
The warranty for defects is excluded pursuant to Article 558(1) of the Civil Code.
All complaints are handled on a case-by-case basis in accordance with the terms of our agreement.
In the event of a product defect, a complaint should be filed immediately upon discovering the problem, but no later than 7 business days from the date of receipt of the order.
The complaint should include:
Order number,
Description of the defect,
Photos showing the defect.
The seller will respond to the complaint within 14 business days.
If the claim is accepted, the possible solutions are:
Product repair,
Replacement with a new unit (if available),
A recommendation from an external art conservation specialist, if the defect is due to the natural aging of the materials.
§ 19 Final Provisions – Language of the Agreement, Governing Law, and Amendments to the Terms and Conditions
1. Language of the Agreement
(a) Contracts concluded through the Store are drawn up in Polish.
b) If the Customer does not speak Polish, they may use the automatic translation feature available on the Store’s website; however, the Polish version shall prevail in the event of any discrepancies in interpretation.
2. Changes to the Terms and Conditions
The Seller reserves the right to amend these Terms and Conditions in the following cases:
a) Changes in laws affecting the operation of the Store,
b) Introducing new features in the Store,
c) Changes to payment or delivery methods.
Customers will be notified of changes to the Terms and Conditions at least 7 days before they take effect.
Orders placed before the changes to the Terms and Conditions take effect will be processed in accordance with the terms and conditions in effect at the time the order was placed.
3. Governing Law
In matters not covered by these Terms and Conditions, the provisions of Polish law shall apply, including in particular:
(a) The Civil Code,
(b) The Consumer Rights Act,
(c) The Act on the Provision of Electronic Services,
(d) The Personal Data Protection Act.
Dispute Resolution
Any disputes arising from these Terms and Conditions shall be settled by the court having jurisdiction over the Seller’s registered office, unless mandatory provisions of law provide otherwise.
